# Chapter 4 # VIOLATIONS I. Basis of Violations. A. Standards and Regulations. 1. Section 5(a)(2) of the Act states that each employer has a responsibility to comply with occupational safety and health standards promulgated under the Act, which includes standards incorporated by reference. For example, the American National Standards Institute (ANSI) standard A92.2 - 1969, "Vehicle Mounted Elevating and Rotating Work Platforms," including appendix, is incorporated by reference as specified in $1910.67. # OSHA STANDARDS # 1926.1202 DEFINITIONS The following terms are defined for the purposes of this subpart only: Acceptable entry conditions means the conditions that must exist in a permit space, before an employee may enter that space, to ensure that employees can safely enter into, and safely work within, the space. Attendant means an individual stationed outside one or more permit spaces who assesses the status of authorized entrants and who must perform the duties specified in § 1926.1209. Authorized entrant means an employee who is authorized by the entry supervisor to enter a permit space. Barrier means a physical obstruction that blocks or limits access. Blanking or blinding means the absolute closure of a pipe, line, or duct by the fastening of a solid plate (such as a spectacle blind or a skillet blind) that completely covers the bore and that is capable of withstanding the maximum pressure of the pipe, line, or duct with no leakage beyond the plate. Competent person means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authorization to take prompt corrective measures to eliminate them. - Confined space means a space that: (1)Is large enough and so configured that an employee can bodily enter it; (2) Has limited or restricted means for entry and exit; and (3)I: not designed for continuous employee occupancy. - Control means the action taken to reduce the level of any hazard inside a confined space using engineering methods (for example, by ventilation), and then using these methods to maintain the reduced hazard level. Control also refers to the engineering methods used for this purpose. Personal protective equipment is not a control. - Controlling Contractor is the employer that has overall responsibility for construction at the worksite. - Note to the definition of "Controlling Contractor". - If the

Those who perform tasks related to the cultivation and harvesting of plants on farms or in greenhouses, nurseries, or forests - such as carrying nursery stock, repotting plants, or watering - related to the production of agricultural plants on an agricultural establishment. 3. For all pesticide use, including uses not covered by 40 CFR Part 170, it is a violation of FIFRA to use a registered pesticide in a manner inconsistent with its labeling. Thus, UOSH has no authority to issue any citations related to pesticide exposures. In the event a CSHO should encounter any cases of pesticide exposure or the lack of an appropriate pesticide label on containers, a referral shall be made to the EPA or to other state agencies administering pesticide laws. 4. EPA also has jurisdiction in non-agriculture situations where pesticides are being applied by pest control companies. This would include, but not be limited to, applications in and around factories, warehouses, office buildings, and personal residences. UOSH may not cite 29 CFR 1910.1200 in such situations. ## III. Construction A. General Responsibilities - Responsibilities for construction inspections are the same as for general inspections. Special situations arising in the construction industry are discussed in this chapter. B. Standards 1. Applicability - The specific standards and regulations are found in Utah Code Ann. $ 34A Chapter 6, UAC R614, 29 CFR 1926, and 29 CFR 1904. UAC R614-1-4 Incorporation of Federal Standards and UAC R614-1-5 Adoption and Extension of Established Federal Safety Standards and State of Utah General Safety Orders establish the source of all the standards which serve as the basis of violations.
