The plan should define the work areas, hazards, and potential emergency situations and hazard prevention methods related to the construction work zone. Recommendation #2: Employers should use visual safety devices (i.e., retroreflective barrels, delineators, portable barricades, cones) to channel construction vehicles to separate them from workers in the work zone. ## Discussion: Both workers on foot and construction vehicles and equipment are necessary parts of any highway, road or street construction project. The National Institute for Occupational Safety and Health (NIOSH) in their studies indicate that almost half of all work zone fatalities occur inside the work area and involve construction machinery, with the majority of those worker fatalities as the result of dump trucks backing over the workers on foot. However, the crew had placed alert signs in each direction of travel in preparation to stop all traffic prior to completely closing the westbound lane, and the crew had just dropped off the victim who was designated as the flagger for the eastbound traffic. Traffic flow was to be coordinated with flaggers by two way radios. The westbound flagger halted traffic in preparation of beginning the one-way-only traffic through the work zone. The westbound flagger attempted to contact the victim (east bound flagger) but received no reply. Witnesses stated the victim walked out into the eastbound lane with his back to oncoming traffic while facing the other flagger and the lane of traffic he stepped into had not yet been stopped. The victim was struck from behind by the vehicle traveling approximately 55 mph. Police interviews with the driver stated that his vision was obscured due to the glare of the sun through his windshield and he did not see the victim. There were three advanced orange flags warning drivers to “be prepared to stop”, and “one lane road just 1500 feet ahead" while the third showed a depiction of a flagger. The victim was also wearing a hi-vis jacket with a class 3 level 2 rating that complies with ANSI/ISEA 107-2010. This jacket was suitable for daytime flagging operations as per the Manual on Uniform Traffic Control Devices (herein after MUTCD). The driver did not slow down or adhere to the signage. The signs were 4 feet by 4 feet in dimension which exceeds the MUTCD requirements and placed mere inches from the roadway. All signs were spaced 528 feet or greater and exceeded MUTCD requirements. # APPENDIX Applicable Regulations In reviewing the WISHA standards, there are defined requirements that deal with highway and road construction flagging operations. Although the investigation of this incident was not regulatory in nature, we offer the following code requirements for information and reference purposes. This is not intended to be a complete list of regulatory guidelines that address these issues: Signaling and Flaggers. WAC [redacted identifier] Except as otherwise required in these rules, traffic control devices, signs and barricades must be set up and used according to the guidelines and recommendations in the Federal Highway Administration's: Manual on Uniform Traffic Control Devices (MUTCD), 1995 Edition- Revision 4, part VI, Standards and Guides for Traffic Controls for Street and Highway Construction, Maintenance, Utility, and Incident Management Operations. WAC [redacted identifier] (1)(a) Flaggers are to be used only when other reasonable traffic control methods will not adequately control traffic in the work zone. # Public Health Summary ## What are the hazards? Workers in highway work zones are exposed to risk of injury from the movement of construction vehicles and equipment within the work zones, as well as from passing motor vehicle traffic. Data from the Census of Fatal Occupational Injuries (CFOI) indicate that of the 841 work-related fatalities in the U.S. highway construction industry between 1992 and 1998, 465 (55%) were vehicle- or equipment-related incidents that occurred in a work zone. ## How are workers exposed or put at risk? Highway workers routinely work in proximity to construction vehicles and motor vehicle traffic. Flaggers and other workers on foot are exposed to the risk of being struck by traffic vehicles or construction equipment if they are not visible to motorists or equipment operators. Workers who operate construction vehicles or equipment risk injury due to overturn, collision, or being caught in running equipment. Highway workers, regardless of their assigned task, work in conditions of low lighting, low visibility, and inclement weather, and may work in congested areas with exposure to high traffic volume and speeds. What recommendations has the federal government made to protect workers' safety? The Federal Highway Administration has developed and maintained the Manual on Uniform Traffic Control Devices (MUTCD), which provides for uniform design and setup of highway work zones. The primary focus of Part 6 of the MUTCD is the interaction between the road user and the work zone. # WORK ZONE SAFETY STOP ## Date Posted: 05/31/2024 According to the Bureau of Labor Statistics (BLS), there are 773 work zone-related fatalities annually. Construction workers who work on highways, roads, streets, bridges, tunnels, utilities, and other similar work for the highway infrastructure are exposed to hazards from outside and inside the work zone. The work is often in congested areas with exposure to high traffic volumes and speeds and can also have the dangers of low lighting, low visibility, and inclement weather. Work is often near moving construction vehicles, equipment, and passing motor vehicle traffic. Note: Dump trucks were responsible for 41% of the deaths, with 52% of those fatalities involving dump trucks backing. ## WORK ZONE HAZARDS When working on or near the roads, there are several hazards that you need to be aware of, including: • Moving and idle construction vehicles and equipment. • Moving vehicles driven by the public or other workers. • Traffic control/management. • Noise from motors and vehicles. • Limited visibility from machinery/dust. - Night work and limited lighting. • Inclement weather. - Natural hazards such as trees and vegetation. . Slip, trip, and fall hazards. • Hazards upon entering or leaving the work zone. ## FLAGGERS Flaggers and other workers can be exposed to the hazard of being struck if not visible to motorists or equipment operators. Flaggers and others setting up or taking down temporary traffic control should wear high visibility clothing (ANSI class 2 or 3) with a fluorescent orange-red or yellow-green background and retroreflective orange, yellow, white, silver, or yellow-green material. # How is traffic control managed? Traffic control is managed through three systems: - traffic control devices: signs, signals, lighting, flares, blocker trucks, crash trucks, pavement markings, channelizing devices, barriers, barricades, etc. - traffic control layout - traffic control persons, which includes their responsibilities, conduct, clothing, equipment, communications, and safety Wherever possible, the hierarchy of controls should be used. Elimination Controls: Ideally, the elimination of the hazards should start at the design phase by considering structures, materials, processes, and measures that would allow for minimal and safe maintenance. When planning a work activity that would close part of the road, consider if it is possible to close the road completely. Are alternate routes available? Engineering Controls: If total closure is not possible, physically separate the workers and the vehicles. Use barriers or other devices to channel traffic, and, where possible, provide a physical separation between the work zone and passing traffic. Install overhead lighting to illuminate the workplace if working overnight or in low-light conditions. Administrative controls: In addition to engineering controls, develop a written traffic management plan. If possible, plan most of the work during non-peak hours or nighttime when the traffic is light. Try to coordinate road work with other necessary works (e.g., tree clearing) to minimize the length of time the road is obstructed. Appoint a competent supervisor to establish and monitor the work zone. OSHA Fact Sheet ## Work Zone Traffic Safety Transportation incidents and workers struck by vehicles or mobile equipment account for the highest number of fatal work injuries, according to the Bureau of Labor Statistics. Workers such as emergency responders, clean-up, utility, demo- lition, construction, and others in areas where there are moving vehicles and traf- fic are exposed to being struck-by moving vehicles. Work zones are used to move traffic in an approved direction and are typically identified by signs, cones, bar- rels, and barriers. ## General There must be a traffic control plan for the movement of vehicles in areas where there are also workers conducting other tasks. Drivers, workers on foot, and pedestrians must be able to see and understand the routes they are to follow. The authority in charge, Federal, state, or local, will determine the configuration of the temporary traffic con- trol zone for motorists and pedestrians. The construction project manager will determine the internal traffic control plan within the con- struction/demolition worksite. When there are several projects, coordinated vehicle routes and communication between contrac- tors will reduce vehicular struck-by incidents. ## Signs Standard highway signs for information, speed limits, and work zones will assist driv- ers in identifying, in designated traffic paths, such directives as: EVACUATION ROUTE; DO NOT ENTER; REDUCED SPEED AHEAD; ROAD CLOSED; and NO OUTLET.
