## Chapter 11 ## IMMINENT DANGER, FATALITY, CATASTROPHE, AND EMERGENCY RESPONSE ## 1. IMMINENT DANGER SITUATIONS - a. GENERAL - 1. Definition -NAC 618.6413 -'Imminent danger means the existence of any condition or practice in a workplace which could reasonably be expected immediately to cause death or serious physical harm to any employee if operations were to proceed in the workplace or if employees were to enter it before the condition or practice is eliminated." - 2. Conditions - The following conditions must be present in order for a hazard to be considered an imminent danger: - A. Death or serious harm must be threatened; AND - B. Most likely, a serious accident would occur immediately OR, if not immediately then before abatement was completed. - NOTE: For a health hazard, exposure to the toxic substance or other hazard must cause harm to such a degree as to shorten life, be immediately dangerous to life and health (IDLH), or cause substantial reduction in physical or mental efficiency or health, even though the resulting harm may not manifest itself immediately. ## b. PRE-INSPECTION PROCEDURES - 1. Imminent Danger Report Received by the Field - A. After the DM or designee receives a report of imminent danger, he/she will evaluate the inspection requirements and assign a CSHO to conduct the inspection. - B. Make every effort to open the imminent danger inspection on the same day the District Office received the report. In any case, open the inspection no later than the day after the receiving the report. - C. When an immediate inspection cannot be made, the DM or designee will contact the employer immediately, obtain as many pertinent details as possible about the situation, and attempt to have any employee(s) affected by the imminent danger voluntarily removed, if necessary. - · A record of what steps, if any, the employer intends to take in order to eliminate the danger will be included in the case file. - · This notification is considered an advance not

- (3) Subsection (2) does not apply to switching work carried out using a switching device where an adequate written procedure has been established by the employer. Subsection 125(3) replaced: O.I.C. 2000-130, N.S. Reg. 52/2000; amended: O.I.C. 2013-65, N.S. Reg. 53/2013. - (4) Where compliance with the personal protective equipment requirements and normal work procedures in effect at the workplace is inadequate to control the risk of exposure to an electrical hazard during work on an energized electrical installation due to an unusual factor in the nature of the work, such as the location or condition of the workplace, a competent person not actively engaged in the work shall be designated as a safety watcher to observe a person who is working on or near an energized electrical installation. - (5 ) A safety watcher required by subsection (4) shall - (a) warn all persons working on or near an energized electrical installation of any potential hazards; - (b) ensure that the requirements of this Part are complied with; - (c) be a competent person able to evaluate relevant hazards, and competent and equipped to initiate a rescue; - (d) be free of any other duties that might interfere with the duties outlined in this subsection; - (e) have the authority to stop work where the task or conditions in the workplace become hazardous; and - (f) remain in the immediate vicinity of the work. - 126 (1) In this Section and in Section 128, 'authority' means an electrical utility whose primary business is the generation or distribution of electricity. - (2) No person shall carry out work that may bring a person or object closer than 6.0 m to an overhead energized power line or power line equipment where the voltage of the overhead energized power line is not known to the person carrying out the work. - (3) Where work is performed in close proximity to an energized overhead power line or power line equipment rated at less than 750 v phase to phase, an employer shall ensure that the

## 71-8303.11. Fitness to Practice; Investigation of Complaints. If the OSFM has reason to believe that a person licensed under this chapter has become unfit to practice as a Fire Equipment Dealer or permit holder based on a complaint filed with the OSFM alleging a violation of a provision of this chapter by a license or permit holder or if a complaint is filed with the OSFM alleging that a licensed person is fraudulently representing themselves as qualified to engage in business as a Fire Equipment Dealer or permit holder, the OSFM may initiate an investigation to determine if violations of these provisions exist.
